Purchase agreement, also know as: a) Earnest Money Agreement, b) Real Estate Purchase Agreement, c) Purchase and Sale Agreement, d) Land Contract. Although it has many names its purpose is the same - purchasing real estate. An Earnest Money Agreement outlines the general terms between the buyer and seller. This is not the transfer of real estate but the outline for when the transfer will take place. These forms list the:

  • Property being sold
  • Buyer
  • Seller
  • Price
  • How the buyer is paying the price
         (Cash, or monthly payments)
  • Where the buyer is obtaining the money
         (Cash from his savings or a mortgage from a bank)
  • When the transfer will take place (called the Closing)
  • How much deposit or earnest money the buyer is providing and;
  • Dozens of other details that need to be agreed upon if you want a successful closing.
